Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Project Atlas (“Atlas”, “we”, “us”, or “our”). By creating an account or using Atlas, you agree to these Terms. If you don't agree, please don't use the service.

1. Acceptance of Terms

By accessing or using Atlas, you confirm that you're at least 18 years old (or the age of majority in your jurisdiction) and that you have the authority to enter into these Terms on behalf of yourself or the business you represent.

2. Description of the Service

Atlas is a growth-intelligence platform for Etsy shop owners, providing research, monitoring, content generation, and analytics tools. Some features rely on third-party AI models to generate suggestions, drafts, or insights. Atlas is a decision-support tool — you remain solely responsible for reviewing and approving any content or action before it's published to your shop or sent to a customer.

3. Account Responsibilities

  • You're responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
  • You agree to provide accurate, current information when creating your account and to keep it up to date.
  • You must notify us promptly at support@atlasgrowth.app if you suspect unauthorized use of your account.

4. Acceptable Use

You agree not to use Atlas to:

  • Violate any applicable law, regulation, or third-party right, including Etsy's own terms of service and seller policies.
  • Generate or publish content that is fraudulent, deceptive, infringing, defamatory, or otherwise unlawful.
  • Attempt to reverse-engineer, scrape, or overload Atlas's infrastructure, or interfere with other users' access to the service.
  • Use automated means to create accounts or circumvent usage limits without our written permission.

5. Intellectual Property

Atlas and its original content, features, branding, and functionality are owned by us and protected by copyright, trademark, and other intellectual property laws. Content you generate through Atlas's tools (for example, listing titles, descriptions, or tags) is yours to use in your shop — we claim no ownership over it. You retain full ownership of any content, data, or materials you upload or connect to your account.

6. Limitation of Liability

Atlas is provided “as is” and “as available,” without warranties of any kind, express or implied. To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages — including lost profits, lost sales, or lost data — arising from your use of, or inability to use, the service. AI-generated suggestions may be inaccurate; you're responsible for reviewing them before acting on them.

Our total liability arising out of or relating to these Terms or the Service will not exceed the amount you paid us in the 12 months preceding the claim.

7. Modifications and Termination

We may modify, suspend, or discontinue any part of Atlas, or these Terms, at any time. We'll make reasonable efforts to notify you of material changes. You may cancel your account at any time from Settings. We may suspend or terminate your access if you violate these Terms or engage in conduct that harms Atlas, other users, or third parties.

8. Payments, Billing & Refunds

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. This means Paddle is responsible for processing your payment, charging applicable sales tax or VAT, issuing invoices, and handling refunds and chargebacks.

Your purchase is also subject to Paddle's own buyer terms. Your subscription to the Atlas service itself remains governed by these Terms.

9. Governing Law

These Terms are governed by the laws of the Republic of Turkey, without regard to conflict-of-law principles. For disputes involving users who qualify as consumers, the Consumer Arbitration Committees (Tüketici Hakem Heyetleri) and Consumer Courts at the user's or our place of residence have jurisdiction. For users acting for commercial or professional purposes, the courts and enforcement offices of Yalova, Turkey have jurisdiction.

If you are a resident of the European Union or the United Kingdom, this section does not affect any mandatory consumer protection rights you may have under the law of your country of residence.

10. Etsy Data

When you connect your Etsy shop, Atlas accesses limited categories of data through Etsy's official API on your behalf, including your shop's listings, order information, and shop statistics.

This data is used solely to provide you, the authorizing seller, with Atlas's features. We do not share this data with third parties or sell it under any circumstances.

If we become aware of a security breach affecting your Etsy data, we will notify you within 24 hours.

DISCLAIMER: THIS APPLICATION IS SOLELY PROVIDED BY ATLAS. YOU ACKNOWLEDGE THAT ETSY, INC. AND ITS AFFILIATES ARE NOT THE APPLICATION DEVELOPER, DO NOT PROVIDE THE APPLICATION SERVICE, AND MAKE NO WARRANTIES OF ANY KIND WITH RESPECT TO THE APPLICATION OR DATA ACCESSED THROUGH IT.
